LA UNION, NM (KFOX14/CBS4) — A man was arrested for allegedly shooting his neighbor’s dog after the dog killed several of his chickens in La Union, New Mexico court documents show.
Deputies arrested 64-year-old Enrique Ortiz.
Deputies were called to the 900 block of Mercantil Avenue on Sunday around 3:17 p.m. on a call about a man shooting a dog.
Ortiz told deputies he had shot his neighbor’s dog, according to the arrest affidavit.
Ortiz told them that several weeks ago the neighbor’s dog killed several of his chickens on his property and that he did not believe Animal Control officers did anything about it, the court document stated.
The arrest affidavit states Ortiz became upset when he saw the dog and was already upset his mother had recently died.
He got a .22 caliber rifle and shot the red and white heeler, the court document states.
After he shot the dog he placed the rifle inside his house, according to the affidavit.
Ortiz wanted to sit on his porch and continue to drink beer while the search warrant was being drafted, according to the affidavit.
According to the court document the owner of “Chica,” the dog, was cited several weeks ago when one of her dogs killed some of Ortiz chickens.
They discussed restitution, but Ortiz asked for over $20,000 for the 22 chickens that were killed, the court document states.
Ortiz is charged with extreme cruelty to animals and negligent use of a deadly weapon.
