Bars in Tampa and Orlando are challenging the Florida Department of Health over choices to obstruct dogs from remaining in the facilities.
Puppies Pub Tampa and Pups Pub Orlando submitted a case recently at the state Department of Administrative Hearings after health authorities provided orders to avoid dogs in what the case refers to as “dog friendly bars.”
In part, lawyers for the bars composed that the department reversed course after earlier permitting dogs. Likewise, they said the bars do not serve food and are created to keep a separation in between dogs and where beverages are prepared.
“Despite its prior enunciation of its interpretation of its rules that dogs were authorized inside bar establishments as long as there was some minimum separation between the dogs and the area were the beverages were prepared, the department changed its interpretation and began prohibiting dogs inside the bar establishment as a whole,” the difficulty said.
The difficulty likewise said the department’s brand-new analysis is void as it “constitutes an agency statement of general applicability which has not been adopted as a rule and is applicable to dog friendly bars statewide.”
In files connected to the case, the Department of Health indicated a state guideline that bars dogs inside food-service facilities, which are specified as consisting of bars.
