A GUY TAKING a dog from a house and taking it for a walk was an “uncommon kind of situation” stated protecting lawyer Michael O’Donnell at Kilmallock Court.
James Heffernan, aged 43, of Main Street, Kilfinane pleaded guilty to one count of robbery at The Homes, Kilfinane on September 11, 2020.
Inspector Gearoid Thompson stated Mr Heffernan got in the residential or commercial property of the plaintiff on the date in concern.
” The celebrations were understood to each other. For factors best understood to himself he chose to take the dog for a walk.
” The plaintiff was at her uncle’s house at the time. When she kept an eye out the window she saw Mr Heffernan strolling the dog. She took control of the dog and made a grievance to gardai,” stated Insp Thompson.
Judge Patricia Harney asked what type of dog was it?
” A bichon,” responded Insp Thompson.
The inspector stated Mr Heffernan has 31 previous convictions consisting of for public order, attack, beverage driving, theft, criminal damage and stopping working/ declining to provide a sample.
Judge Harney stated the accused “certainly has a major beverage issue”.
Michael O’Donnell, lawyer for Mr Heffernan, stated it was an “uncommon kind of situation”.
The court heard that Mr Heffernan had issues over the dog being inside all the time.
” The celebrations were understood to each other and he understood the dog. There was no breaking and going into. He took the dog for a walk and later on it was totally revitalised,” stated Mr O’Donnell.
Judge Harney stated due to the level of the accused’s angering there are “certainly severe concerns”.
Mr O’Donnell handed in a variety of referrals on behalf of his customer.
Judge Harney stated Mr Heffernan’s physician is really understanding.
” Consume and drugs lead him into severe issues. I am putting him on a probation bond of 6 months. He is not to engage of alcohol or unprescribed drugs,” stated Judge Harney.
The judge likewise bought Mr Heffernean to appear in Macroom District Court in relation to a suspended sentence he formerly got at that court.
