OTTAWA — The Supreme Court of Canada is set to rule today on whether Quebec’s restriction on growing marijuana plants at home is constitutional.
The judgment remains in a case very first brought prior to the courts in 2019 by Janick Murray-Hall.
Murray-Hall’s legal representative argued that Quebec’s restriction on owning and cultivating plants for personal usage is unconstitutional and opposes the federal marijuana law enacted in 2018.
The federal law enables individuals to grow or own up to 4 marijuana plants at home, however the Quebec federal government prohibited growing for personal usage, with fines running in between $250 and $750.
