Hearing a contempt petition submitted by Singh, who retired as extra director general of authorities in 2020, CAT asked chief secretary A Santhi Kumari to appear prior to it if the federal government stops working to make sure payment of pension to him within a week.
CAT said it had actually passed orders two times directing the Centre, represented by the ministry of home affairs (MHA), and Telangana federal government, represented by the chief secretary, to give pension to Singh, an IPS officer of 1987 batch.
“But, the instructions have actually not been adhered to by the participants. This action plainly totals up to contempt of court and the exact same has actually been taken cognizance of. When we will pass orders directing the chief secretary to appear personally prior to this tribunal, the state federal government’s counsel has actually looked for time,” it said.
CAT even more said: “Though we have already granted sufficient time to the respondents, considering the request of their counsel a week’s time is granted to pay the provisional pension to the petitioner.”
The state federal government said it was still in the procedure of approving provisionary pension to the candidate and looked for 2 weeks’ time.
Singh, who has actually finished 33 years of service, submitted a petition in the tribunal, competing that CAT’s interim orders — provided in May and June this year on pension — have actually not been executed up until now. He was assigned to Telangana after bifurcation of Andhra Pradesh in 2014.
Singh composed to MHA, looking for early retirement in June 2020. As per the statutory arrangement of the All India Services guidelines, a threemonth notification duration will need to be served initially. Also, Telangana government did not issue any proceedings, conveying non-acceptance of his retirement before the said date of expiry of threemonth notification.
“After the lapse of threemonth notice period, a memo was issued by the state government stating that disciplinary proceedings were contemplated and hence, permission to go on premature retirement was rejected. Relevant GOs were issued after September 26, 2020. In view of the statutory provision that voluntary retirement comes into force on expiry of the three-month notice period, the state government’s rejection had no bearing,” Singh said.
